1. Acceptance of Terms
By participating in events with Hyqe Club, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
2. Health and Fitness
Participants must be in good health and physically capable of participating in the hiking adventure. It is your responsibility to consult with a healthcare provider if you have any health concerns or medical conditions that may affect your ability to participate.
3. Safety and Conduct
- Participants must follow all safety instructions provided by the organizers and guides.
- Participants must wear appropriate clothing and footwear suitable for hiking.
- Alcohol, drugs and any illegal substances are strictly prohibited during the activity.
- Any behavior that jeopardizes the safety of the participant or others will result in immediate removal from the activity without refund.
4. Equipment and Personal Belongings
- Participants are responsible for bringing necessary personal equipment, such as water bottles, hats, sunscreen and any other items specified by the organizers.
- The organizers are not responsible for any loss, damage or theft of personal belongings.
5. Assumption of Risk
Participants acknowledge that hiking involves inherent risks, including but not limited to physical injury, death or property damage. By participating, you assume all risks associated with the activity.
6. Release and Waiver of Liability
In consideration of being permitted to participate in the hiking adventure, you release and hold harmless Hyqe Club, its officers, employees, agents and volunteers from any claims, demands, actions or causes of action arising out of or related to any loss, damage or injury, including death, that may be sustained by you, whether caused by the negligence of the Releasees or otherwise.
7. Indemnification
You agree to indemnify and hold harmless Hyqe Club from any loss, liability, damage or costs, including court costs and attorneys' fees, that may arise due to your participation in the hiking adventure, whether caused by the negligence of the Releasees or otherwise.
8. Medical Treatment
In the event of an emergency, you consent to receive medical treatment deemed necessary by the organizers. You are responsible for all costs related to medical treatment and agree to indemnify and hold harmless the Releasees from any liability arising from such treatment.
9. Photography and Media
By participating in the activity, you consent to being photographed and/or recorded for promotional and marketing purposes without compensation. If you do not wish to be photographed or recorded, please notify the organizers in writing prior to the event.
10. Cancellation and Refunds
- The organizers reserve the right to cancel or modify the activity due to weather conditions, safety concerns or other unforeseen circumstances. In such cases, participants will be notified as soon as possible and a refund or rescheduling options will be provided.
- Participants who cancel their booking within two weeks of the activity date may be eligible for a partial refund, as determined by the organizers.
11. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
