1. Acceptance of Terms

By participating in events and activities organised by Hyqe Club, you agree to comply with these terms and conditions. Please read them carefully before taking part.

2. Health and Fitness

Participants must ensure that they are physically capable of participating in the hiking adventure. If you have any health concerns or medical conditions that may affect your participation, you should consult a healthcare professional beforehand and inform Hyqe Club of any relevant limitations.

3. Safety and Conduct

• Participants must follow all safety instructions provided by Hyqe Club organisers and guides.
• Participants must wear appropriate clothing and footwear suitable for the activity.
• Alcohol, illegal drugs and other prohibited substances are not permitted during the activity.
• Behaviour that endangers the safety of the participant or others may result in removal from the activity, subject to applicable booking and refund terms.

4. Equipment and Personal Belongings

• Participants are responsible for bringing the necessary personal equipment, including water, a hat, sunscreen and any additional items specified for the event.
• Participants are responsible for their personal belongings. Hyqe Club is not responsible for loss, theft or damage, except where liability cannot lawfully be excluded.

5. Assumption of Risk

Participants acknowledge that hiking and outdoor adventure activities involve inherent risks, including uneven terrain, changing weather, slips, falls, physical injury and, in serious circumstances, death or property damage. Participants must exercise reasonable care and follow all safety instructions. Participation is subject to applicable South African law.

6. Release and Waiver of Liability

To the extent permitted by applicable law, participants agree that Hyqe Club and its officers, employees, agents and volunteers will not be held liable for loss, damage or injury arising from participation in an activity where such liability may lawfully be excluded. Nothing in these terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited.

7. Indemnification

Participants may be required to indemnify Hyqe Club against reasonable losses, liabilities or costs arising from their unlawful conduct, breach of these terms or negligent actions, to the extent permitted by South African law. This provision does not apply to liability that cannot lawfully be excluded or transferred.

8. Medical Treatment

In an emergency, participants consent to reasonable efforts by Hyqe Club organisers to arrange appropriate emergency assistance or medical treatment where necessary. Participants remain responsible for their medical expenses and should disclose relevant medical information and emergency contact details before the activity. Hyqe Club does not guarantee the availability of immediate medical services.

9. Photography and Media

Photographs or recordings may be taken during Hyqe Club activities for promotional and marketing purposes. Where required, consent will be obtained in accordance with applicable privacy and data protection laws. Participants who do not wish to appear in promotional material should notify Hyqe Club in writing before the event. Any objection will be handled in accordance with applicable law.

10. Weather Conditions and Route Changes

Hyqe Club activities take place outdoors and are subject to weather, terrain and other environmental conditions. Hyqe Club reserves the right to modify, postpone or cancel an activity where adverse weather, unsafe conditions or other unforeseen circumstances make this necessary. Where an event is cancelled by Hyqe Club, participants will be offered rescheduling or a credit, or a refund where required by applicable law or the specific booking terms.

11. Cancellations and Refunds

• Hyqe Club may cancel or modify an activity because of weather, safety concerns or other unforeseen circumstances. Participants will be informed as soon as reasonably possible, and available rescheduling, credit or refund arrangements will be communicated.
• For day activities, cancellations made by participants within 14 days of the scheduled event may qualify for a partial refund, subject to the booking terms and applicable law.
• For overnight activities and activities involving accommodation or advance commitments, a minimum of six weeks' notice of cancellation by the participant is required. The applicable refund or cancellation charges will depend on the booking terms and non-recoverable costs.
• Any event-specific cancellation, transfer or refund conditions communicated during booking form part of the applicable booking terms, subject to South African consumer protection law.

12. Governing Law

These terms and conditions are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in accordance with applicable South African law.
